Law Lords Ignorance of Islam and Muslims is Exposed PDF Print E-mail

The Times and the Guardian today host a story about a Lebanese woman granted asylum in the UK yesterday by the House of Lords because she feared how she would be treated under Shari'ah law if she were to return to Lebanon.

First of all let us be absolutely clear that Lebanon does not implement Shari'ah law, rather they, like all other so-called Muslim countries apply man-made law under the guise of democracy and freedom but which are in reality dictatorship and oppression.

Under Shari'ah law the mother has a better right to reside with a child, after divorce, as long as she is suitable and does not remarry, until the child reaches the age of 7.  However, the husband has equal rights of access to the child during this period and must also ensure that he provides food, clothing and shelter for the child and even for the mother if she is needy for her role to look after their child.

Upon the age of 7, although the father then has a better right to have the child reside with him, the mother still enjoys equal rights of contact and if he is not suitable to look after the child for any reason, such as his violence or the fact that he will not properly maintain the child or is an alcoholic etc... the child will continue to be looked after by and reside with the mother.

It may even be the case that the father may want his former wife and mother of the child to remain in custody of the child, in which case the mother can even demand a salary to continue to maintain his child on top of the regular maintenance costs that the father pays (as already outlined above) which are guaranteed by the divine law. In addition, regardless of who has residence with the child, the party looking after the child must not travel abroad without informing the other party as to the location of the child since the child has been given a divine right to have access to both its parents.  

The comment that the Shari'ah is man-made in a male dominated society is rich coming from people (in the West) who live in a society where the biggest industries are pornography, alcohol and gambling (all prohibited in Islam) and all designed to exploit the instincts and desires of human beings.

Unlike capitalism, when the Shari'ah was implemented on Earth (under the Khilafah system from 622 until 1924 AD) social diseases which plague Western societies such as promiscuity, adultery, pornography, pedophilia and homosexuality etc... were non-existent since the Shari'ah does not allow the sexuality of either man or woman to be abused and rather channels the procreation instinct properly through the institution of marriage.

Further, unlike the West, where women are still little more than subordinate to their men folk and who are ritually exploited for the sexual gratification of men through pornography, cat-walks, fashion and the media generally, Islam does not even allow a man or woman to be employed except for what they can do with their ‘hands' i.e. their skill and effort. Any use of the sexuality of either men or women for monetary gain or advantage is completely condemned thereby protecting the social fabric of society like no other system on Earth.

In addition, unlike the crude Western legal system which tries to force men to be like women and vice versa, Islam treats men and women in accordance to their natural disposition, without trying to change their nature and by fulfilling all their needs, desires and emotions with a perfect system as laid down by the one who created them and hence knows them better i.e. Allah (SWT).

Women have their own rights and duties as do men and neither should be envious of what Allah (SWT) has granted to the other. There is no competition within Islam for them to out do each other or to feel depressed because they are not able to be the other gender. Through defining the role of men and women within society Islam treats women as mothers, sisters, daughters and as the guardians of the family, elevating them to a status unheard of in the history of mankind, protecting their honour and dignity against the lusts and gratification of men and dealing with them on the basis of their knowledge and skills and not their appeal to men. Men on the other hand do not need to dress up in batman costumes and hang off Big Ben to gain their divine (not man-made) right to have custody and access to their own children as the ‘Fathers for Justice' cases highlight.

As for the case at hand, any Islamic judge would need to hear from both parties before deciding on custody, unlike the British courts which have apparently just heard from the woman concerned. Moreover the decision to grant custody to the father would only be upheld, upon the age of seven if he is suitable taking into consideration his ability to maintain the child and give it an Islamic upbringing. If he is proven to be a danger to the child the Judge in Islam will grant a Fatwa for the mother to remain in custody of the child (as stated above).

The judgement of the ‘law lords' in this case highlights the reality of the British courts and Western Jurisprudence, which is biased against Islam and Muslims, which has little or no understanding of Islam together with no urge to find out any more about it and who are ready to judge cases based on only hearing the facts of one side, namely the appellant.

The superiority of Islamic law in every department of the judiciary from the innocence of anyone until proven guilty, to hearing from both sides before applying divine law and through ensuring their divine rights (which are not given one day only to be taken away by men the next) show its clear superiority to man-made law and are compelling reasons not just to introduce Shari'ah in the social system in the UK but also for the British to consider it an alternative to the failure of Capitalism as a way of life.
